SALE TERMS - COVERINGS Sunshine Coast
PAYMENT
1.1 A deposit for the materials to be supplied is required for confirmation of all orders unless the invoice terms state a different amount. 1.2 Special indent & import orders may require up to 100% payment for confirmation of such orders, unless otherwise stated. 1.3 Deposit and indent order payment amounts may be forfeited if such orders are cancelled by parties other than the supplier. 1.4 Unless otherwise stated, full payment for products to be supplied is required before collection or delivery of materials. 1.5 If Coverings Sunshine Coast is required to store any stock materials beyond 4 weeks, full payment for such materials is required, and storage charges may apply. 1.6 Any variation to the scope of work as quoted will be subject to further charges. 1.7 Payments made by American Express or Diners Club credit cards will incur a 3% surcharge of the invoiced amount to cover such credit card charges. 1.8 In the event that required payment(s) are not made as prescribed, Coverings Sunshine Coast reserves the right to cancel orders and apply deposits to its costs and expenses. 1.9 Quoted prices for products in stock are valid for 28 days. 1.10 Quoted prices for products to be ordered from interstate or overseas are subject to review at any time prior to invoicing. 1.11 Coverings Sunshine Coast reserves the right to charge interest on overdue accounts at the rate of 15% per annum calculated daily until payment is made.
PRODUCT ORDERS
2.1 The purchaser acknowledges that products supplied by Coverings Sunshine Coast may incur minor variations in colour, grain, shape, size, and texture. Accordingly, the purchaser shall not make any claim for replacement or compensation in respect of such minor variations, and in any event, no claim may be brought after products are installed. It is the purchaser’s responsibility to inspect any ordered products prior to the delivery of such products. Risk is passed on to the purchaser after delivery. 2.2 Products will only be accepted as returns provided that: a) They are in their original undamaged and unopened boxes; and b) They are returned to Coverings Sunshine Coast within 7 days from the date of collection or delivery; and c) The quantity of stock the supplier has with the same batch number as the products to be returned exceeds 50 square metres; and d) Except for defective goods, there will be a restocking fee which will be deducted along with freight costs; and e) Relevant invoice is accompanied with returned product(s).
Please note that: a) Indent orders from overseas or special orders will not be accepted for return in any circumstances unless they are defective; and b) Products purchased at a special/sale price are not accepted as returns/credits.
INSTALLATION, DELIVERY & STORAGE
3.1 Where installation forms part of this quotation, payment for installation must be made no later than upon practical completion of work, as advised by Coverings Sunshine Coast. Where installation is required, the purchaser must ensure that all required site works have been completed to permit installation. Coverings Sunshine Coast reserves the right to charge $160 p/h if installation is delayed for any reason other than the fault of the installer. 3.2 Coverings Sunshine Coast makes no representations or warranties concerning the structural adequacy of any structure on which products are to be installed and accepts no responsibility for the consequences of installation carried out by Coverings Sunshine Coast, the purchaser, or the purchaser’s own installer. 3.3 Coverings Sunshine Coast takes no responsibility for any damage to walls from removal of skirting boards. Repair to any walls damaged in this process is the responsibility of the purchaser as the damage is unavoidable. 3.4 Coverings Sunshine Coast may arrange delivery of ordered goods on the purchaser’s behalf and at the purchaser’s expense but will accept no liability for any loss or damage arising as a consequence of the delivery process. 3.5 Coverings Sunshine Coast does not take responsibility for orders arriving late due to shipping issues.
TITLE TO GOODS
4.1 Risk in the ordered goods shall pass to the purchaser upon collection by the purchaser or the carrier designated to collect and deliver the goods. However, title in the goods shall not pass unless and until the purchaser has paid the total balance of the invoice cost of the goods, including delivery and installation charges, if any.
WARRANTY
5.1 Coverings Sunshine Coast warrants that its goods are free from defects due to faulty manufacture of material. If any of the goods are defective, Coverings Sunshine Coast will, at its option, provided that the purchaser has promptly notified Coverings Sunshine Coast and has not installed the goods, either replace them or reimburse the purchaser for the purchase price. In any event, the limit of Coverings Sunshine Coast's liability shall be no greater than the purchase price of the goods. 5.2 This warranty does not exclude, limit, or modify any rights the purchaser has under the Australian Consumer Law (ACL), which guarantees that goods are of acceptable quality and fit for purpose. 5.3 Coverings Sunshine Coast offers a 2-year warranty covering defects in installation.
This installation warranty does not cover:
Damage due to improper maintenance, moisture, or general wear and tear
Product defects covered under the manufacturer’s warranty
Issues arising from structural movement or subfloor conditions beyond our control
If any installation-related defects arise within 24 months, we will inspect the issue and, if covered, repair or replace the affected area at no cost.
SLIP RESISTANCE
6.1 Caution – Any form of flooring can be slippery, especially when wet, and all necessary precautions must be taken when used in areas where tiles are exposed to any liquids. 6.2 CLASSIFICATION The classification has taken into account the recommendations of Australian Standards; however, they are given for general guidance only. The classifications are valid for the given application under NORMAL CONDITIONS and should not be taken to provide accurate product specifications for specific requirements. 6.3 WARNING: Other standards and building code requirements may affect your selection of products. Consideration should be given to the footwear, type of pedestrian traffic, and cleaning methods expected. Floors should also be adequately protected against soiling from following trades during installation and against scratching devices at entrances to buildings (e.g., mats, shoe scrapers, static devices, etc.).
